Will my same sex marriage be recognised in other countries?

30th October 2017

The problems faced by same-sex individuals who have married here in Scotland, but who are originally from outwith Scotland, having their status recognised in their home state are coming to light- much as was the case when civil partnership was introduced over a decade ago. The issues down south (and in France) were highlighted recently in Pink News but may well be more acute for individuals in Scotland because of differences in how we have introduced equal marriage.

Couples who are in an overseas civil partnership can marry in Scotland by converting their overseas union into marriage. After same-sex marriage was introduced the Scottish Government specifically extended the provision to individuals from outwith Scotland. This goes further than England and Wales, where marriage conversion is only available to individuals who entered into a civil partnership in the UK.

If you are affected by these issues you can get in touch with Rachael Kelsey who can put you in contact with those lobbying for recognition.
