Rachael Kelsey follows up the piece in the Financial Times yesterday on the Lugano Convention with a more detailed look in Scottish Legal News at the family law issues that arise from the UK no longer being a party to the Convention.
The Convention provides agreed rules about which court can deal with cross-border maintenance (spousal and child support) and makes it easier to have orders made in one state recognised in another. The UK ceased to be a party to the Convention at the end of the Brexit transition period, which ended on 31st December 2020.
