Is my divorce private in Scotland?

Rachael Kelsey was on BBC Radio 4’s Law in Action programme today taking part in a discussion on no fault divorce. She talked about the law in Scotland- which allows couples to get a ‘no fault’ divorce after they have been separated for a year, if they both agree, or after two years separation. She also discussed the privacy issues that arise for divorcing couples, proposals for reform and whether there was still a sound justification for a fault based system, which requires individuals to disclose personal and private information to the state to access divorce.
