Divorce and Cohabitation Jurisdiction Changes

12th January 2021

Rachael Kelsey has written in Scottish Legal News today on the new law for jurisdiction in divorce and cohabitation claims, which came into force on 1st January 2021, following the end of the Brexit transition period.

The new law affects when the Scottish courts can hear divorce actions, and deal with the related financial claims- and not just in international, or EU member state cases. It also brings big changes in intra-UK matters, so if you have connections with England and Wales or Northern Ireland you should be getting good advice from a lawyer in the relevant part of the UK about what the changes mean for you.
