Are post-nuptial agreements enforceable in Scotland?

Alison Edmondson is joining the Family Lawyers Association of Ireland at its conference and AGM being held at University College Cork. Alison will be contributing to a panel on enforcement of court orders chaired by Her Honour Judge Rosemary Horgan, President of the District Court. In relation to financial matters Alison will be exploring how Scottish divorce procedure differs from many other jurisdictions. Freedom of contract and privity of contract give rise to a culture of enforcement issues occurring against a background of private contracts. She will discuss the mechanism by which these can be rendered enforceable in a similar (often identical) manner to orders of the court in the Scottish system of direct enforcement.
